Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of instanthero.ca and app.instanthero.ca (together, the “Services”), operated by Anton Kats (“InstantHero”, “we”, “us”, “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

The Services are intended for a general audience. Children under 13 may browse public portions of the Services but may not create an account.

Accounts are created using third-party authentication providers (such as Google). We do not independently verify user age. You are responsible for ensuring that information you provide is accurate and that you are eligible to create an account.

You are responsible for activity that occurs under your account.

2. The service

InstantHero allows users to create, customize, and send printed postcards, including written messages and designs, and to optionally submit images of postcards for collection or public display.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Orders, printing, and fulfillment

All postcards are custom-printed based on information you provide. Please review your order carefully before submitting.

You may attempt to cancel an order by emailing [email protected]. We do not guarantee that a cancellation request will be received or processed before printing begins.

All sales are final. We do not offer refunds. If an order is successfully cancelled before printing, we may, at our discretion, allow you to send a replacement postcard without additional payment.

4. Shipping and delivery

We do not guarantee delivery dates or delivery times.

Once an order is submitted for printing and mailing, delivery is handled by third-party service providers (including printers and postal services). We are not responsible for delays, loss, damage, or errors caused by third parties.

5. Payments

Payments are processed through third-party payment processors (such as Square). We do not receive or store full credit card numbers.

Payment processors may have their own terms and policies, which apply to your use of their services.

6. User content

You retain ownership of the content you submit, including messages, images, and designs (“User Content”).

By submitting User Content, you grant InstantHero a non-exclusive, royalty-free, worldwide license to use, reproduce, print, display, and distribute that content solely for the purpose of providing the Services.

If you choose to submit content for public display, you grant us the right to display that content publicly and to use it for promotional and marketing purposes.

You represent and warrant that you have all rights necessary to submit your content and that it does not infringe the rights of any third party or violate any law.

7. Public submissions and moderation

Submission of postcard images or text for public display is optional.

All public submissions are subject to human review. We may approve, reject, remove, or restrict public content at any time, for any reason, at our sole discretion.

Do not include sensitive or personal information in content you choose to submit for public display.

8. Prohibited uses

You agree not to use the Services to submit content that is unlawful, abusive, defamatory, obscene, threatening, infringing, or otherwise objectionable.

We reserve the right to remove content and restrict access that violates these Terms.

9. Account suspension and termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we determine it is necessary to protect the Services, users, or others.

10. Disclaimer of warranties

The Services are provided “as is” and “as available”. We make no warranties, express or implied, regarding the Services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, InstantHero shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Our total liability arising out of or relating to the Services shall not exceed the amount you paid to us for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless InstantHero from any claims, losses, liabilities, damages, or expenses arising from your use of the Services or your submitted content.

13. Governing law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

14. Changes to these terms

We may update these Terms from time to time. The “Last updated” date above will reflect the most recent changes. Continued use of the Services after changes means you accept the updated Terms.
